ENSEMBLE – TERMS & CONDITIONS

1. INTRODUCTION

Welcome to Ensemble (“the App”, “we”, “us”, “our”), a platform connecting tutors and students for arts-based education, including but not limited to acting, singing, dance, musical theatre, and musical instruments.

By accessing or using Ensemble, you agree to be legally bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the App.

2. ELIGIBILITY

  • You must be at least 16 years old to create an account.

  • Users under 18 must:

    • Have parental/guardian consent

    • Have permission to use any payment method

  • We reserve the right to request proof of age or consent at any time.

3. USER ACCOUNTS

3.1 Account Creation

Users may register as:

  • Tutor

  • Student

You agree that:

  • All information provided is accurate and up-to-date

  • You will not impersonate another person

  • You are responsible for maintaining account security

3.2 Account Suspension

We may suspend or terminate accounts if:

  • You breach these Terms

  • You engage in fraud, abuse, or harmful conduct

  • We suspect illegal activity

4. PLATFORM ROLE

Ensemble acts as:

  • A marketplace facilitator

  • NOT an employer of tutors

  • NOT responsible for the quality, legality, or outcomes of lessons

All tutoring services are contracts directly between tutor and student.

5. BOOKINGS & PAYMENTS

5.1 Payment Processing

  • Payments are processed securely via Stripe

  • By using the App, you agree to Stripe’s terms

5.2 Payment Flow

  • Student pays at time of booking

  • Funds are held securely by Ensemble

  • Funds are released to the tutor:

    • After the student confirms the session occurred

    • Within 1–3 business days

5.3 Commission

  • Ensemble takes a 33% commission

  • Tutors receive 67% of the session fee

5.4 Disputes

If a student disputes a session:

  • Funds may be temporarily withheld

  • Ensemble may investigate and make a final decision at its discretion

6. CANCELLATIONS & REFUNDS

6.1 Tutor Cancellations

  • Tutors must provide reasonable notice

  • Repeated cancellations may result in account suspension

6.2 Student Cancellations

  • Refund eligibility depends on:

    • Timing of cancellation

    • Tutor’s cancellation policy

6.3 No-Shows

  • If a student fails to attend:

    • No refund may be issued

  • If a tutor fails to attend:

    • Full refund issued

7. RATINGS & REVIEWS

  • Students may leave ratings (1–5 stars) and written reviews

  • Reviews must:

    • Be honest and not defamatory

    • Not contain abusive or offensive content

We reserve the right to remove reviews at our discretion.

8. USER CONDUCT

You agree NOT to:

  • Harass, abuse, or discriminate against others

  • Share inappropriate or explicit content

  • Circumvent the platform (e.g., taking payments outside Ensemble)

  • Use the platform for illegal purposes

Violation may result in immediate termination.

9. SAFETY & RESPONSIBILITY

  • Tutors are responsible for delivering services safely and professionally

  • Students are responsible for their own participation

  • Ensemble does not guarantee:

    • Tutor qualifications

    • Lesson outcomes

    • User behaviour

10. INTELLECTUAL PROPERTY

  • All App content (branding, design, features) belongs to Ensemble

  • Users retain rights to content they upload but grant us a license to use it for platform operation and marketing

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Ensemble is not liable for:

  • Losses resulting from tutor/student interactions

  • Missed sessions or dissatisfaction

  • Technical issues or service interruptions

  • Indirect or consequential damages

12. INDEMNIFICATION

You agree to indemnify Ensemble against any claims, damages, or legal costs arising from:

  • Your use of the App

  • Your breach of these Terms

  • Your interactions with other users

13. TERMINATION

We may terminate or suspend access:

  • At any time

  • Without prior notice

  • For any breach or risk to the platform

14. CHANGES TO TERMS

We may update these Terms at any time. Continued use of the App constitutes acceptance of changes.

15. GOVERNING LAW

These Terms are governed by the laws of England and Wales.
